Lawsuit against what? A dead company? He already has grounds to file on the delinquent note and he hasn't.

On the equity what would he file? That a financial services company went under in the wake of the sep08 disaster?

If we don't give him anything his tax people might tell him he must hire a collection agent and/or file demand with the courts so he can show to the IRS he made real effort to recover the debt.

Kind of inviting a lawsuit, don’t you think?  I am not comfortable issuing a statement like that.

Markus I have concluded that I am not going to see any payments on the Note from Paradigm to me, nor any value in the equity in Paradigm Companies that I purchased for $1MM.  Please correct me if I am mistaken.

If I am  unfortunately correct, then would you send me an email stating that Paradigm is winding down and will not be able to repay the Note and will not return any value for the equity I own, so that I can write these amounts off on my 2009 taxes please.

This does not need to be a long treatise, just a clear statement of the reality.

Thanks   Tom
