***REMINDER*** PLEASE ATTEND PLAN COMMISSION HEARING ON THE BEACH PROTECTION ORDINANCE ON JULY 26th AT 7PM

Thanks to all who sent emails to the Plan Commission last week supporting a strong Town beach protection ordinance. The Town Plan Commission will be holding another hearing on the Beach Protection Ordinance on July 26th at 7 pm at the Community Center gym. These meetings have been dominated by the shrill voices of lakefront owners threatening the Plan Commission Members with lawsuits AND telling us to “shut-up”. One “gentleman” even told the Commission Members they should be “locked up”. This is not our Town. While it is not pleasant to sit through these meetings, the Plan Commission deserves our support for proposing sensible limits on construction on the beach. PLEASE ATTEND.

The APC’s proposed Beach Protection Ordinance does not contain radical proposals. Other states and towns have imposed entire bans on construction on beach property within proximity of the Lake. The Indiana DNR recommends a minimum 75 ft setback from the OHWM for all construction. The State of Wisconsin DNR requires a 75 ft setback. St. Joseph Michigan banned construction within 200 feet of the OHWM and also imposed a moratorium on seawalls. Grand Haven Michigan adopted a similar ordinance. Yet the APC is now backing down from even requiring compliance with the existing 20-ft. rear setback required under Long Beach Ordinances for every property in the Town (THIS REQUIREMENT IS DELETED IN THE APC’S LATEST JULY 16TH VERSION OF THE ORDINANCE! Also please see LBCA’s July 14 comments posted on the LBCA webpage above the proposed ordinance asking the Town to both:

require lakefront property owners to comply with the 20-ft. rear setback requirement, and provide a process for the adoption of an even more protective “Lake Michigan Setback” based on historic erosion rates (as suggested by IDNR) and/or lake levels and dynamics (as done in Michigan) to be revisited every 10 years.
