NOAH FELDMAN: Why is the Supreme Court stacking the five most important
cases of the term into the last two weeks? “Part of the answer is human
nature: Hard decisions get delayed because procrastination is a signal
of thoughtfulness. Another part is practical. A hard case means more
back-and-forth among the justices, which requires more time.” It also
“suggests the court may be a little worried about a world in which its
approval rating stands at 44 percent.” [Link]

RICHARD VEDDER: “We now have 115,000 janitors, 83,000 bartenders,
323,000 restaurant servers, and 80,000 heavy-duty truck drivers with
bachelor’s degrees." Federal financial-assistance programs are not
serving any of them well. [Link]

WILLIAM COHAN: Not much has changed on Wall Street. “Neither Dodd-Frank
nor the Volcker Rule nor bank-capital requirements nor the other
regulations that will ultimately get written -- with a lot of help from
Wall Street’s lawyers and lobbyists -- will change the behavior of the
hundreds of thousands of bankers, traders and executives who work on
Wall Street and who do the things every hour of every day that slowly
but surely have had a tendency to lead to the collective action that
cause financial crises.”

AL HUNT: “For Democrats, June has been the cruelest month; there has
been discouraging economic news; the re-election candidate has made
mistakes and seems out of his comfort zone. The supposedly superior
Obama campaign looks amateurish, and complaints about the operation’s
insularity have reached a fever pitch.” [Link]
DAVID CRANE: California politicians made the wrong bet in 1999 when
they “decided that investment markets would cover 100 percent of the
cost of retroactive pension increases they granted that day to hundreds
of thousands of state workers. . . . The result has been a penalty to
California’s budget that has averaged $2 billion a year ever since and
that will cost the state billions more for decades to come.” [Link]

THE EDITORS: A U.S.-EU free-trade agreement “has the potential to
jump-start economic growth and create millions of jobs, even as it
sidesteps the paralyzing debate on both sides of the Atlantic over
austerity versus stimulus.” [Link] And, THE EDITORS write, “let’s
drop the feigned outrage” over national security leaks and do something
about them. “Congressional hearings are the only sensible way forward.
They would inevitably involve much partisan grandstanding. Better to
contain it to a congressional forum than let it spill into a legal
proceeding, and to save the investigations for leaks intended to damage
U.S. interests.”
