Dear Robert,

The latest with the recount is that the Virginia Board of Elections has scheduled a drawing of names to decide the winner for Thursday… if the court doesn’t intervene first.

The fate of the House of Delegates lies in the outcome of the race between Democrat Shelly Simonds and Rep. David Yancey. The race went to Simonds during the recount, but then a three-judge panel decided a day later to reconsider a ballot that had multiple marks on it in Yancey’s favor.

There are a number of legal reasons as to why this new ballot should not have been considered or accepted, and we are making every available effort to support Shelly’s and the Democratic party's legal fight.
