The Orphan Drug Tax Credit (ODTC) encourages drug companies to develop new treatments for rare diseases affecting fewer than 200,000 Americans at one time. Since ODTC was enacted in 1983 as part of the Orphan Drug Act (P.L. 97-414), more than 3,500 potential treatments have been designated as an orphan drug, and more than 500 orphan therapies have been approved by the FDA. This is a direct result of the incentives provided by the ODA, including the tax credit.
Unfortunately, the House-passed Tax Cuts and Job Act (H.R.1) repeals the Orphan Drug Tax Credit. The Senate bill, now being considered, waters down the ODTC by lowering the ODTC from 50 percent of qualified medical expenses and drug testing to just 27.5 percent.
The ALS Association Greater Philadelphia Chapter opposes any effort to either repeal or lower the value of tax credits for qualified medical expenses or drug testing through the ODTC.
The ALS Association, as a member of the National Organization for Rare Disorders, is fighting to restore the full Orphan Drug Tax Credit in the Senate and to ensure that it is included in the finale Senate-House agreement on a tax measure.
