Please convey an extra big Thank You to Hunter for checking about that from the road. We really appreciate it!! What we wanted to connect with Hunter about are several significant new developments, some very good, some not so much… One of the updates is that we (Les) met with Senator Murray’s senior FDA staffer and provided the key info about the rogue committee, and Senator Murray’s staff “got it” right away and expressed a significant interest in helping. So, that was a wonderful response. We also have connected with Senator Alexander’s senior FDA staff but had to wait on proceeding with that meeting due to some major regulatory filings that we had to concentrate on. We are, indeed, still planning to get the sanitized and shortened version of the paper to you and Hunter – it just got overtaken by events during the last couple of weeks after the Hill staff meetings, due to some new developments that are part of the updates we’d like to discuss. We also have several other updates… whenever feasible, it would be great to discuss in a call. We have not yet reached out to Chris, as we are not yet able to pursue the change of counsel for the existing cases, and also not able to undertake a new case…. also due to some new developments. Let’s connect whenever feasible. Kind regards, Linda *From:* Eric Schwerin [mailto:eschwerin@rosemontseneca.com <eschwerin@rosemontseneca.com>] *Sent:* Thursday, May 05, 2016 2:14 PM *To:* Linda Powers *Subject:* Follow Up Linda- Hunter is traveling but asked me to follow up with you and make sure that there is nothing you were looking for Hunter to do at the moment. I think when we touched base you were working on finalizing that one-pager and Hunter had volunteered to get it to Senator Murray but we never heard more from you. I assume it got over taken by other events? I know Hunter has had a few talks with Dennis but I just wanted to make sure I didn’t drop the ball on anything here. Also, I understand from Chris Boies that you were supposed to talk with him but had to move the call due to an emergency. Are you still interested in following up with Chris? Thanks, Eric Eric D. I'm cc'ing my business partner, Eric Schwerin, who can also give some input/suggested edits. In regards to the sensitivity of this document, you may want to provide us with a sanitized version. Sen. Murray is not in town right now so we won't be able to physically give it to her, plus she will likely turn around and give it to her staff anyways. In the interest of time, we were planning to approach her chief of staff with this, so if you would prefer that we share a sanitized version with him, please send me that. Thanks for keeping me posted about the FDA reply. Best, Hunter On Tue, Mar 29, 2016 at 10:58 PM, Linda Powers <lpowers@nwbio.com> wrote: Dear Hunter: Attached is a shortened version. As you will see, we have cut about 2/3 of a page of text and eliminated a number of the secondary points from the story. It is now less than 2 pages, but not quite down to 1-1/2 pages. Please take another look and let us know if this will do. If you think it still needs to be shorter, it would be great if you could suggest (with fresh eyes) what to cut. IMPORTANT NOTE: This paper tells the true and unvarnished facts. As such, it is ultra ultra sensitive. If this paper were to fall into the wrong hands, it could lead to severe repercussions for NW Bio. So, please only give the paper in PDF format and please only to Patty herself – not her staff. If that’s not possible, and you have to give it to her staff, please tell us before you give it to them, and we will make a sanitized version. FYI, we submitted our reply letter to FDA today, requesting a formal in-person meeting with us and our independent experts. It will be interesting to see whether FDA grants us the meeting (which is absolutely the normal thing to do)…. or refuses to meet with us, as the DMC did last summer…. Thanks again for your help. Dear Hunter: Thanks very much for your feedback. Appreciate it. We literally just filed our reply letter with FDA (at 3:58 pm!... ahead of 4 pm cutoff). So, now we can turn back to this memo and take another crack at shortening it. Do you have any suggestions about what to cross out? We will aim to get a reduced version back to you this evening. Dear Linda, Thank you for putting this together. I think it is really important to get this down to no more than 1 1/2 pages. My suggestion would be to stick with the key issue and request for this 1-pager as you will have other opportunities to expand on the background later down the road. Let me know when you have an idea of timing for turning this around. Thanks again. We really struggled to make it as tight as possible, but ther is so much key information that we just did not get it into 1 page. If you read it with fresh eyes and see how it can be cut down from 2 pages, suggested edits to do so would be welcome. If you think it’s OK at a length of 2 pages, then let’s put our heads together about how best to send it out the door. Thanks! We just got off a conf call with them, receiving the data and…. it is excellent! Would you like to hear it (under our CDA)? We can give you a quick call. [?] Attached is the mostly-but-not-completely finished 1-pager that I drafted during the weekend. It was devilishly difficult to make it tight enough. Comments welcome. I’m about to turn back to finishing the last 2 points as noted in the paper. We have not reached out to Chris yet but plan to do so first thing in the morning, now that we have the update data and we know that it’s good. Last night and this morning, we’ve been working intensively on obtaining some key info for the 1-pager, as well as tied up in calls with our Board members. We hope to have the 1-pager to you in the next hour or so. Thanks SO much for your help! We are really grateful. Kind regards, Linda -- R.
