The news comes as Senate Majority Leader Mitch McConnell has teed up a Thursday showdown over the nuclear option to push through Gorsuch's confirmation over the protests of Democrats. The details: "The documents show that several passages from the tenth chapter of his 2006 book, 'The Future of Assisted Suicide and Euthanasia,' read nearly verbatim to a 1984 article in the Indiana Law Journal," they report. "In several other instances in that book and an academic article published in 2000, Gorsuch borrowed from the ideas, quotes and structures of scholarly and legal works without citing them." The White House pushed back, calling the claims "a false attack" and a "baseless, last-second smear" by people who don't want to see Gorsuch confirmed. And the author of the law article, Abigail Lawlis Kuzma, released a statement through Gorsuch's team saying she does "not see an issue here, even though the language is similar." But six experts on academic integrity differed in their assessment, "ranging from calling it a clear impropriety to mere sloppiness." "I've never seen a college plagiarism code that this would not be in violation of," said Syracuse professor Rebecca Moore Howard, who has written extensively on the issue. REPEAL RUNS AGROUND, AGAIN - The White House's latest effort to revive its Obamacare repeal fell flat Tuesday night after "conservative and moderate Republicans met and realized they had two very different understandings of the changes sought by top Trump officials," Rachael and Josh Dawsey report. The late-night huddle with Vice President Mike Pence and GOP caucus leaders in the Capitol basement failed to clarify the issue, "leaving Hill insiders speculating whether the White House offered two different potential deals - or lawmakers selectively heard what they wanted," they report. What's next: Republicans plan to meet again today. But with GOP lawmakers still far apart on even the parameters that would get both sides closer to yes, it's unclear where they go next. "There were no agreements tonight in principle, and certainly no agreements in terms of a foundation," Freedom Caucus Chairman Mark Meadows said Tuesday after the meeting. While the gesture is not technically a filibuster since cloture has already been filed and it will have no effect on McConnell's plans to confirm Gorsuch, Merkley's move drew quick cheers from liberal activist groups that have propelled Democrats' Supreme Court filibuster. Merkley's campaign also got in on the action with an email to supporters that vowed he would "stand there and talk - for hours, if necessary - to pressure the Republican leadership to pull Gorsuch's nomination." McCONNELL: FILIBUSTER STAYS FOR LEGISLATION - Senate Majority Leader Mitch McConnell may be more than willing to blow up the 60-vote threshold for SCOTUS nominees but there's one thing he's promising to never change: the filibuster for legislation. "Who would be the biggest beneficiary of that right now? It would be the majority, right?" McConnell told reporters. "There's not a single senator in the majority who thinks we ought to change the legislative filibuster. Not one." Xavier Becerra. Gomez had locked up several endorsements heading into the primary, including from Becerra, now the state's attorney general.
