The Employee Retirement Income Security Act imposes obligations on employers who offer 401(k)/403 (b) plans—and on the individuals who operate the plan. Plan participants may (and do) bring claims for breaches of fiduciary obligations. We will cover: what the risk is; proper selection of investment advisors and investment options; operational diligence—best practices that can keep the employer (and other fiduciaries) out of trouble; participant claims over investment fund fees; and responding to participants’ claims and Department of Labor investigations.

Our survey-style update covers developments in copyright, trademarks, patents and trade secrets, including Supreme Court cases on copyright in cheerleading outfits, trademarks for scurrilous words, and venue and other issues in the patent wars, as well as lower court cases involving trade secret litigation against Uber and others. We will also take a brief tour of other hot topics in adjacent areas such as privacy and block chain technology.

2:55 pm – Opioid Crisis Litigation and Addressing Addiction in the Workplace

States, cities and counties across the country are filing lawsuits against pharmaceutical companies, distributors of opioids and healthcare providers. Similar to lawsuits against tobacco companies and gun manufacturers, these lawsuits seek millions of dollars in reimbursement against those in the chain of distribution for the costs of opioid pain prescriptions, addiction-related treatment and other monetary losses incurred by state and local governments in dealing with the effects of the opioid crisis. The current status of these lawsuits, the claims alleged and the potential defenses will be among the topics covered. We will also discuss important considerations for employers managing employees with addictions.

These non-transitional CLE programs have been approved in accordance with the requirements by the NY, NJ and PA CLE Boards. DE CLE credit pending.


Attendance at the complete program on December 13 will qualify for a maximum of six credit hours for PA (including two hours ethics credit), and 7.2 hours credit for NJ (which includes 2.2 hours ethics credit), and 7 hours for NY (including 2 hours ethics credit).
