Plan participants may (and do) bring claims for breaches of fiduciary obligations. We will cover: what the risk is; proper selection of investment advisors and investment options; operational diligence—best practices that can keep the employer (and other fiduciaries) out of trouble; participant claims over investment fund fees; and responding to participants’ claims and Department of Labor investigations. 11:10 am – Taming Technology: Managing the Risks of Cybersecurity, Cloud and the Internet of Things Presented by Alexander Major [ https://sites-mccarterenglish.vuturevx.com/email_handler.aspx?sid=e1055737-61ee-45f0-b428-77ee7f2f083b&redirect=http%3a%2f%2fwww.mccarter.com%2fAlexander-W-Major%2f ] and Franklin Turner [ https://sites-mccarterenglish.vuturevx.com/email_handler.aspx?sid=e1055737-61ee-45f0-b428-77ee7f2f083b&redirect=http%3a%2f%2fwww.mccarter.com%2fFranklin-C-Turner%2f ] Corporate cybersecurity is a complex and dynamic beast. Learn about the threat and leave with practical solutions that will help your company evolve and survive. Noon – Networking lunch 12:45 pm – IP Update: Cheers, Jeers, Fears and Gears Presented by Susan Goldsmith [ https://sites-mccarterenglish.vuturevx.com/email_handler.aspx?sid=e1055737-61ee-45f0-b428-77ee7f2f083b&redirect=http%3a%2f%2fwww.mccarter.com%2fSusan-Okin-Goldsmith%2f ] Much has happened this year in the IP world. Our survey-style update covers developments in copyright, trademarks, patents and trade secrets, including Supreme Court cases on copyright in cheerleading outfits, trademarks for scurrilous words, and venue and other issues in the patent wars, as well as lower court cases involving trade secret litigation against Uber and others. We will also take a brief tour of other hot topics in adjacent areas such as privacy and block chain technology. 1:50 pm – Three’s a Crowd: Ethics in Multi-Party Relationships Presented by Christopher Loeber [ https://sites-mccarterenglish.vuturevx.com/email_handler.aspx?sid=e1055737-61ee-45f0-b428-77ee7f2f083b&redirect=http%3a%2f%2fwww.mccarter.com%2fChristopher-C-Loeber%2f ] Your company gets sued and your insurance carrier appoints a lawyer to defend. Problem solved or problem created? This program will review the basics of the tripartite relationship and explore the ethical issues that can arise with insurer-provided defense counsel. 2:55 pm – Opioid Crisis Litigation and Addressing Addiction in the Workplace Presented by Wilfred Coronato [ https://sites-mccarterenglish.vuturevx.com/email_handler.aspx?sid=e1055737-61ee-45f0-b428-77ee7f2f083b&redirect=http%3a%2f%2fwww.mccarter.com%2fWilfred-P-Coronato%2f ] and Hugh Murray [ https://sites-mccarterenglish.vuturevx.com/email_handler.aspx?sid=e1055737-61ee-45f0-b428-77ee7f2f083b&redirect=http%3a%2f%2fwww.mccarter.com%2fHugh-F-Murray%2f ] States, cities and counties across the country are filing lawsuits against pharmaceutical companies, distributors of opioids and healthcare providers. Similar to lawsuits against tobacco companies and gun manufacturers, these lawsuits seek millions of dollars in reimbursement against those in the chain of distribution for the costs of opioid pain prescriptions, addiction-related treatment and other monetary losses incurred by state and local governments in dealing with the effects of the opioid crisis. The current status of these lawsuits, the claims alleged and the potential defenses will be among the topics covered. We will also discuss important considerations for employers managing employees with addictions. 4:00 pm – Optional stadium tour (30 minutes) These non-transitional CLE programs have been approved in accordance with the requirements by the NY, NJ and PA CLE Boards. DE CLE credit pending. Attendance at the complete program on December 13 will qualify for a maximum of six credit hours for PA (including two hours ethics credit), and 7.2 hours credit for NJ (which includes 2.2 hours ethics credit), and 7 hours for NY (including 2 hours ethics credit).
