TODAY'S HOUSE LEADERSHIP RACE IS JUST AN AUDITION - Rep. Kevin McCarthy (R-Calif.) will be elected by his colleagues as majority leader, leaving three others to duke it out for the GOP whip slot. But POLITICO's Jake Sherman and John Bresnahan explain this is only the dress rehearsal for a potential fall showdown: "Rep. Steve Scalise of Louisiana huddled with Southerners, worked over Pennsylvanians and tried to assuage the frayed nerves of conservatives. Rep. Peter Roskam of Illinois tried to snatch some of Scalise's supporters and lobbied undecided voters in his quest to become the next House majority whip. On the day before the election for majority whip, the Capitol was a madhouse as
Scalise, Roskam and Rep. Marlin Stutzman (R-Ind.) prepared for what likely will be a two-round election to choose the next member of the House Republican leadership.

-- "But there's a far different - and much more cynical - thought running through the minds of many House Republicans: None of this actually matters. There are fewer than 40 legislative days remaining until the next leadership election, which will be held after the midterms on Nov. 17. On that Monday, Speaker John Boehner (R-Ohio) and the rest of his leadership team will stand for reelection. This election, these people say, is a mere tryout."

-- The New York Times' Carl Hulse: "The coming months will determine who can emerge as heir apparent to Mr. Boehner in the absence of [ousted Majority Leader Eric] Cantor and get established as the new voice and face of the House majority. Will it be Mr. McCarthy, if he can demonstrate the leadership skills required to shepherd the sometimes unruly conservative majority, despite his roots in blue-state California? Will it be one of the committee chairmen, like Representative Jeb Hensarling of Texas, who passed on this leadership fight but will wield increased power with Mr. Cantor gone? Or will a surprise candidate rise up and find a way to unite the House Republican factions?"

-- The WSJ's Kristina Peterson and Michael R. Crittenden: "Conservative lawmakers, bristling from what they see as a domineering approach from the current leadership, said they would be scrutinizing the winners of Thursday's contest closely in the brief months before the next round of elections. Between now and November, Congress will have to address a looming shortfall in the highway trust fund, the expiration of the Export-Import Bank-which many conservatives want to eliminate-and funding of the government beyond the end of the fiscal year in September."

SUBPOENAS FLY - "House Staff Under Scrutiny As Trading Probe Heats Up," WSJ, A1. By Brody Mullins and Andrew Ackerman: "Prosecutors are gathering evidence for a grand-jury probe into whether congressional staff helped tip Wall Street traders to a change in health-care policy, an indication the long-running investigation has entered a more serious phase. Public documents show federal law-enforcement officials and the Securities and Exchange Commission are seeking records and other evidence from the House Ways and Means Committee and a top congressional health-care aide, Brian Sutter, staff director of the committee's health-care subpanel.

-- "The SEC sent subpoenas to the House committee and Mr. Sutter seeking documents and testimony in the matter, according to documents made public by Rep. David Camp (R., Mich.), who is the committee chairman, and Mr. Sutter. Separately, the Justice Department issued a subpoena to Mr. Sutter to compel him to testify before a federal grand jury at the U.S. District Court for the Southern District of New York, according to Mr. Sutter's public disclosure, which was included in the congressional record per House rules."

NYT ENDORSES ESPAILLAT OVER RANGEL - The editorial board writes: "After a humiliating censure by Congress four years ago for failing to pay taxes and other ethical lapses, Representative Charles Rangel has steadily lost power in Washington. After nearly 44 years in office, it is now time for him to yield to the next generation. In Tuesday's Democratic primary for New York's 13th Congressional District, we recommend Adriano Espaillat, a New York State senator, who will be a better representative of this district stretching from Upper Manhattan into parts of the Bronx."

DWS PULLS HER HAMMY, BUT MEMBERS BEAT PRESS IN SOFTBALL CLASSIC -"After two consecutive years of media victories, the congressional team routed the press 10-5 in the annual Congressional Women's Softball Game," Sarah Smith writes for POLITICO. "Florida Rep. Debbie Wasserman Schultz pulled her hamstring trying to reach second base ... but came out on crutches to celebrate her team's victory.... Washington's elite - including Supreme Court Justice Sonia Sotomayor, House Minority Leader Nancy Pelosi (D-Calif.) and Speaker John Boehner (R-Ohio) turned out to watch the game. House Minority Whip Steny Hoyer (D-Md.) presented the trophy to the members. ... The Congressional Women's Softball Game
aims to raise money for and promote awareness of breast cancer."

SENATE TO BIDEN: WE WANT HILLARY - Manu Raju and Maggie Haberman report for the hometown paper: "This is Joe Biden's reality after nearly four decades in the Senate, countless fundraisers for his party and endless ego-massaging of his colleagues: Not a single Democratic senator, including the two from his home state, are publicly urging him to run for president. And this is Hillary Clinton's lot: A majority of current Democratic senators are calling on her to run in 2016, years before the election and months before she's expected to even make up her mind whether to seek the White House again. That despite the fact that her eight years in the Senate ended with more than a dozen colleagues
spurning her presidential campaign in favor of a younger upstart senator from Illinois."

PATENT OFFICE GOES ON OFFENSE VS.REDSKINS -Theresa Vargas reports on A1 of the WaPo: "The U.S. Patent and Trademark Office canceled the Washington Redskins' trademark registration on Wednesday, a move that won't force the NFL team to change its name but fuels the intense fight by opponents to eliminate what they view as a racial slur against Native Americans. The 99-page decision by the Trademark Trial and Appeal Board said the team's name and logo are disparaging. ... But its effect is largely symbolic. The ruling cannot stop the team from selling T-shirts, beer glasses and license-plate holders with the moniker or keep the team from trying to defend itself against others who try to profit
from the logo. ...

-- "Sen. Maria Cantwell (D-Wash.), who persuaded 49 other members of Congress to send a letter last month to the National Football League on the issue, interrupted a debate on the Senate floor to herald the decision."

CORKER, MURPHY AGREE: HIKE GAS TAX TO FIX HIGHWAYS - Scott Wong and Burgess Everett report for POLITICO: "Sens. Bob Corker and Chris Murphy said Wednesday that the way to fix the depleted Highway Trust Fund is staring Congress right in the face: a tax hike. Corker, a Tennessee Republican, and Murphy, a Connecticut Democrat, pitched a bold plan that calls for federal gasoline and diesel tax increases to shore up the Highway Trust Fund, which pays for most federal transportation programs mostly through a tax on gasoline. ... Politically it'll be a monstrously tough sell, especially for many of Corker's GOP colleagues who see anything resembling a tax hike as toxic."

HATCH: LERNER EMAILS MAY BE GONE FOREVER - Rachel Bade reports for POLITICO: "Ex-IRS official Lois Lerner's crashed hard drive has been recycled, making it likely the lost emails of the lightening rod in the tea party targeting controversy will never be found, according to multiple sources. 'We've been informed that the hard drive has been thrown away,' Sen. Orrin Hatch of Utah, the top Republican on the Finance Committee, said in a brief hallway interview. Two additional sources told POLITICO the same late Wednesday, citing IRS officials. ... the revelation is significant because some lawmakers and observers thought there was a way that tech experts could revive Lerner's emails after they
were washed away in a computer crash in the summer of 2011.

-- "House Oversight and Government Reform Committee Chairman Darrell Issa (R-Calif.), for example, subpoenaed her damaged hard drive earlier this week, when he asked for 'all hard drives, external drives, thumb drives and computers' and 'all electronic communication devices the IRS issued to Lois G. Lerner.'"

BRIAN SCHWEITZER INSULTS EVERYONE -National Journal's Marin Cogan finds out what happens when you spend a few days with the former Montana governor: "This was the week that Sen. Dianne Feinstein took to the Senate floor to accuse the CIA of spying on congressional staffers investigating the agency's treatment of terrorism suspects under the Bush administration. Schweitzer is incredulous that Feinstein-considered by her critics to be too close to the intelligence community-was now criticizing the agency. 'She was the woman who was standing under the streetlight with her dress pulled all the way up over her knees, and now she says, 'I'm a nun,' when it comes to this spying!'
he says. Then, he adds, quickly, 'I mean, maybe that's the wrong metaphor-but she was all in!'

-- "(It wasn't the only time Schweitzer was unable to hold his tongue. Last week, I called him on the night Majority Leader Eric Cantor was defeated in his GOP primary. 'Don't hold this against me, but I'm going to blurt it out. How do I say this ... men in the South, they are a little effeminate,' he offered when I mentioned the stunning news. When I asked him what he meant, he added, 'They just have effeminate mannerisms. If you were just a regular person, you turned on the TV, and you saw Eric Cantor talking, I would say-and I'm fine with gay people, that's all right-but my gaydar is 60-70 percent. But he's not, I think, so I don't know. Again, I couldn't
care less. I'm accepting.')"
