Beau,
For my money, after the important legal discussion you and ES will have
today, there are two political/press points to hit:
1) Agree to continue to work together, and do the press arm together
(letting his team carry the load, since they seem much more willing to put
their boss' name in the press, and they're pros at it). This week was a
great first step, let's see if we can build on it. publicly. DE and NY are
natural partners on financial issues, that should be to our benefit (this is
much different than you partnering with Miller or Cortez-Masto, for
example).
2) Establish at least a preliminary timeline, if not explicit agreement, on
when and how you two will formally break from the discussions with the
banks. Is it done implicitly, by the two of you establishing an actual case
against a bank (or more)? Or, for example, is it done explicitly, by writing
a letter to Miller and Perrelli saying DE and NY are formally pulling out of
the negotiations (which would effectively scuttle any deal).

I have not spoken to Ted about this, so I reserve the right to be wrong or
