1. Despite the stay of litigation, which notably, you breeches by filing the motion, we need to respond to the motion. We think it's more appropriate to file a responsive than to issue a statement to the press.

2. Obviously, your decision to file the motion in the first instance was damaging to ability to earn income, the lynchpin of any workable settlement agreement.

3. We will further consider your counteroffer and respond. Unfortunately we now have to go down dual paths -- litigation and settlement talks -- a scenario we had previously both agreed was the best route, but you decided to breach.
