EMAIL DETAILS

Vadim – Thank you. I am working on all the items you list below. With regard to hiring Nardello, I think this warrants further discussion as soon as possible. Devon and I just discussed it and he can also explain if you and he speak. We are standing by to discuss.

Dear Heather,

Hope, you are fine and enjoyed your weekend.

With regard to our previous communications, please find below the following information on the FTi and David Leiter engagements:

We had thorough internal discussions and would like to follow your kind advice to their engagement.

We are ready to do that for the initial month. The arrangements for the months to come will be discussed and decided following the first month of our joint cooperation.

Please elaborate as to the legal format of this engagement. I put our CLO Andriy in copy, so that he would be involved and could offer his comments.

Let's get down to work with these partners on the basis of the proposed agenda.

Also, in addition to what was suggested as a working plan for both FTI and David, I would like us to add a few more points with some concrete targets and indicators.
Within the next 24 hours i will provide you and the new partners with some additional points to be considered for the first month engagement.
Aalso, I would like you to consider in which way and who you and these partners could work with to resolve the issues given below, since the stakes are high right now:

- The issue of politically motivated proceedings initiated against us in Ukraine( I provided you with the information on that earlier)

- Nikolay US entry ban

Please, take into account that though he has an entry ban ( supposedly due to the fact that he is on some list), he has a valid ( not revoked) US visa. ( passpart and visa copies attached)

Concerning the Nardello investigations we believe that Kroll report presents all required information and I could get in touch with them to make additional enquiries. Please, suggest wether it would be more appropriate if your company did that instead.

Best,

Vadim
