Court of Appeals Applies Strict Standard in Public Bidding, Limiting Discretion

a firm other than the lowest bidder, even though a majority of the board believed
the other bidder offered superior service.

was whether the Town Board could make a determination of which bidder was "responsible"

"What the Town did in essence was to award the contract to a vendor it believed
to be more responsible," the Court wrote. The court said finding a bidder "more
responsible" is tantamount to finding the low bidder not responsible at all.
Pursuant to Town Law § 122 and General Municipal Law §103, all contracts for public
work must be awarded to "the lowest responsible bidder." The central purposes of
New York's competitive bidding statutes are the "(1) protection of the public fisc
by obtaining the best work at the lowest possible price; and (2) prevention of favoritism,
improvidence, fraud and corruption in the awarding of public contracts." Consistent

looked to both the specific language of the law and the purpose of the statute.
The Court found both objectives enumerated above required the award to lowest bidder,
so long as that bidder could meet the requirements specified in the bid. Had the
bid provided for additional subjective evaluation with equal opportunity for each
bidder to address the additional criteria, the award may have been proper.
Officials must exercise great care in drafting bid documents and evaluating the
responding companies. Absent any provision for further evaluation or a clear demonstration
of a bidder's "non responsibility," elected officials have no discretion in determining
who will best serve their constituents.

heroic work is well known. He created a new Swedish passport, the Schutzpass,
which looked more imposing and official than the actual Swedish passport. He reportedly
put up huge placards of it throughout Budapest to make the Nazis familiar with
it. He unilaterally announced that it granted the holder immunity from the death
camps.

States put into the War Refugees Board, Wallenberg was able to purchase about thirty
buildings, which he used as hospitals, schools, soup kitchens, and safe houses
for over 8,000 children whose parents had already been deported or killed by the
Nazis.
