Pursuant to Town Law § 122 and General Municipal Law §103, all contracts for public work must be awarded to "the lowest responsible bidder." The central purposes of New York's competitive bidding statutes are the "(1) protection of the public fisc by obtaining the best work at the lowest possible price; and (2) prevention of favoritism, improvidence, fraud and corruption in the awarding of public contracts." The Court found both objectives enumerated above required the award to lowest bidder, so long as that bidder could meet the requirements specified in the bid. Had the bid provided for additional subjective evaluation with equal opportunity for each bidder to address the additional criteria, the award may have been proper. Officials must exercise great care in drafting bid documents and evaluating the responding companies.
