I hope you are staying warm on the east coast! Following your introduction, we engaged and are working with Lisa Barclay who joined Boies. Unfortunately, Lisa has little pull on the payment side of things. This will require lobbying and getting in front of policy makers. I must tell you that ONE GUY at CMS recently submitted a policy transmittal -- one guy -- and it basically ensured that Medicare patients would have limited access to choosing Dropless Cataract Surgery. In fact, he basically ensured that only rich people would have access. He also ensured that Medicare would continue to incur an additional $1B in costs related to cataract surgery drugs (i.e. paying for the expensive drops). It simply blows my mind that one bureaocrat in government can make a decision like this and make 80 year old cataract patients put eye drops in their eyes 300 times after surgery ... etc. I keep hearing that Medicare is looking for ways to save money -- and this seems like a no brainer. It also seems like a great way to endear oneself to lots of Medicare age voters. But who knows?! We are going to keep fighting, but I wish I had access to someone who could give us a fair shot at making this option available to people with physical disabilities, poorer Medicare patients and others. If you have any ideas, I would be sincerely grateful. Best Regards, Mark L.
