Broward County has amended the procedures for the 2014 Tax Certificate Sale and wants to provide ample notification of the forthcoming changes. Perhaps the most significant change will be the elimination of the bidding group (primary/sub-account) structure and the adoption of a "Single Good Faith Bidder Rule" for the 2014 Tax Certificate Sale. > > The Single Good Faith Bidder Rule provides that each Bidding Entity shall register only once and cannot have a Prohibited Contractual, Legal or Financial Relationship with any other Bidding Entity registered in the Broward County Tax Certificate Sale. A Prohibited Contractual, Legal, or Financial Relationship shall mean two or more Bidding Entities that have, or plan to have, a common economic interest that would occur upon award of any tax certificates issued by Broward County. > > Note: All Bidding Entities are now required, upon registration, to submit a signed Acknowledgment of adherence to the Single Good Faith Bidder Rule. > > In addition to the Single Good Faith Bidder Rule requirements, participants registering with the use of an Employee Identification Number (EIN) will be required to: > > Identify their relationship to the Bidding Entity they are representing. > Identify the type of legal entity they represent (e.g. sole proprietor, partnership, corporation, nonprofit, estate, etc.) > Identify the state in which the Bidding Entity is domiciled (i.e. the state where the Bidding Entity has been formally created). > Acknowledge the Bidding Entity has been issued the EIN directly by the United States Internal Revenue Service (IRS). > Acknowledge the Bidding Entity has obtained its EIN, issued by the IRS, for the purpose of federal tax administration and that it was not obtained for the sole purpose of participation in tax certificate auctions, tax lien auctions, or lotteries. > Acknowledge, if requested by representatives of Broward County, that they will provide official documentation evidencing the legal existence of the Bidding Entity within 48 hours of such request. > Other changes to the 2014 Tax Certificate Sale include: > > Increasing the minimum deposit amount for each registered bidder to $2,000. > Closing the bidder registration process five (5) business days prior to the actual sale date to allow staff time to review proper documentation of all registrants. > Broward County is confident these enhanced procedures will result in a tax certificate sale which is designed to be fair and competitive for all participants.
