DEMS' BENGHAZI DILEMMA - Daniel Newhauser and Emma Dumain for CQ Roll Call: "House Democrats are considering naming just one person to the special committee investigating the 2012 attack in Benghazi, Libya, a move that would serve as a symbolic protest of the panel's creation, but also allow them access to information obtained by committee Republicans to rebut them. The Benghazi committee proposal was floated late Thursday in a letter to Democratic members from Rep. Rosa DeLauro, the co-chairwoman of the Democratic Steering and Policy Committee and a trusted member of Minority Leader Nancy Pelosi's inner circle ... Democrats plan to meet Friday morning to discuss their options ... Rep.
Henry A. Waxman, D-Calif., another member of Pelosi's inner circle, on Thursday reiterated his support for appointing a full slate of Democrats to the committee, but dismissed suggestions that Democrats opt in with partial participation by naming just one of their own to go up against Republicans. 'I think we ought to participate with all five,' Waxman told reporters."

--POLITICO's Jake Sherman has more details about Democrats' thinking: "Democrats want to be there to respond to Republicans, and stand up for the administration. One person they especially want to be in the room for: Hillary Clinton. Democrats are aware the Republicans are certain to call the former secretary of State to testify, and if there are no Democrats present, the leading contender for the party's 2016 presidential nomination would be walking into a minefield ... [Rep. Elijah] Cummings has received praise for going toe to toe with Oversight Chairman Darrell Issa (R-Calif.), and emphasized he could stand up to Republicans on the new panel. The message: Democrats must be there."

SHINSEKI FACES SUBPOENA, CALLS FOR AUDIT - CNN: "Veterans Affairs Secretary Eric Shinseki has ordered a 'face-to-face audit' at all Department of Veterans Affairs clinics, a spokeswoman told CNN on Thursday. Earlier in the day, the House Veterans Affairs Committee voted to subpoena Shinseki in the wake of accusations that his department is responsible for deadly delays in health care at some of its hospitals. The Shinseki subpoena will cover e-mails that allegedly discussed the destruction of a secret list, first reported by CNN, of veterans waiting for care at a Phoenix VA hospital. The House panel agreed to issue the subpoena in a verbal vote Thursday morning. Shinseki will testify May 15
before the Senate Committee on Veterans' Affairs, CNN also learned. Attention on the secretary follows months of CNN exclusive reporting about U.S. veterans who have died while they waited for treatment at VA hospitals across the country."

SPAT OVER R&D TAX CREDIT - Billy House for National Journal: "Despite a White House veto threat, the GOP-led House plans to vote Friday on a bill making permanent a research-and-development tax credit for businesses-without offsetting the $156 billion cost over the next decade. The White House and some Democrats who oppose the measure as-is have acknowledged they support the aim, but they won't back the bill because they say it represents a case of political inconsistency-if not hypocrisy. They point out that Republicans continue to insist that an extension of long-term unemployment insurance be fully paid for. Minority Whip Steny Hoyer told reporters this week that 'we are for the R&D
tax credit,' but that Republicans 'are doing the right thing in the wrong way.' Majority Leader Eric Cantor responded to the Democratic positioning by calling it 'ironic' and proof that Democrats are 'all talk and no action on jobs,' which he said the measure will help to produce."

LANDRIEU TARGETS GOP AFTER KEYSTONE FAILURE - Darren Goode and Burgess Everett for the hometown paper: "The collapse of Senate Keystone XL talks has set a new political blame game in motion - and no one has more at stake than Sen. Mary Landrieu. Facing a difficult reelection battle, the Louisiana Democrat is pointing the finger at Republicans, namely Senate GOP leader Mitch McConnell (R-Ky.), for letting a deal slip away that could have allowed a stand-alone vote this month on TransCanada's long-sought oil pipeline project. Meanwhile the GOP is once again labeling Landrieu as powerless despite her recent rise to the top of the Senate energy committee. 'I don't think it bodes well for Mary
Landrieu,' said one oil industry lobbyist who supports her campaign. 'It shows that even as chair of that committee, she doesn't have enough clout to bring it up to a vote on the floor. It scares the hell out of me.'

--"There's sharp disagreement over just how many votes a Keystone measure could attract. Republican leaders and aides declined to predict whether Keystone could get 60 votes on the floor, though whip counts from bill sponsor Sen. John Hoeven (R-N.D.) and reporters closely following the talks put the project backers at least a couple of votes short. And Democrats contend the GOP turned down a chance to vote on Keystone because they knew it wouldn't pass. But Republican aides argue that if Landrieu truly wanted Keystone's approval, she would have demanded a 50-vote threshold for Keystone as an amendment to the Senate's energy efficiency bill rather than the 60 votes to approve a pipeline
she's fought so hard for."

TRANSITIONS - Sarah Lovenheim, former deputy director of new media to Senate Majority Leader Harry Reid (D-Nev.), has started as communications director for Young Invincibles, which Lovenheim says works to "elevate the voices of young adults on health care, higher education and jobs."

HOUSING BILL LOSES DEM SUPPORT - Cheyenne Hopkins recaps the drama over the Johnson-Crapo housing bill for Bloomberg: "Six Democrats whose support is crucial to a U.S. Senate plan to replace government-owned mortgage firms Fannie Mae and Freddie Mac (FMCC) have decided they won't support the proposal without major revisions, dimming its chances of becoming law this year. ... The six senators -- Charles Schumer of New York, Sherrod Brown of Ohio, Jeff Merkley of Oregon, Robert Menendez of New Jersey, Elizabeth Warren of Massachusetts, and Jack Reed of Rhode Island -- agreed that the structure of the re-insurer seemed unworkable and the bill lacked sufficient support for affordable housing
goals. Such changes could weaken Republican support for the measure."

RAHM: OBAMA SET TO ACT ON DEPORTATIONS - Katherine Skiba for the Chicago Tribune: "Mayor Rahm Emanuel and Rep. Luis Gutierrez today predicted the country will change its immigration policies this year, with the congressman expressing more optimism about comprehensive immigration reform making it through the Republican-led House. Emanuel, who was President Barack Obama's first chief of staff, said the president would take executive action if the House did not pass a bill ... Gutierrez, a champion of immigration reform, said he was encouraged by this week's primary win by Rep. Renee Ellmers, R-N.C., who is among Republicans who favor immigration reform and who beat back a challenge from the
right." Gutierrez and Emanuel also met with Homeland Security Secretary Jeh Johnson on Thursday:

--The Wall Street Journal reports that Senate Majority Leader Harry Reid and Sen. BURWELL GETS SOME GOP BACKERS - Sylvia Mathews Burwell, poised to become President Barack Obama's chief administrator of Obamacare, picked up key Republican supporters as she appeared Thursday in the first of her two confirmation hearings. POLITICO's Jennifer Haberkorn: "Burwell made no promises to change the Affordable Care Act as she testified in front of the Senate Health, Education, Labor and Pensions Committee. Democrats widely praised her while Republicans blasted the health law that Burwell will have to operate and focused on state-specific health care issues. [Sen. John] McCain appeared as a White House witness ... McCain noted his opposition to the health law and its rough first
year, but praised Burwell. 'That is why I advised her against taking the leadership position at HHS,' he said. 'After all, who would recommend their friend take over as captain of the Titanic after it hit the iceberg? Obviously, she ignored my advice and accepted the nomination anyway, continuing her pattern of public service.' ... In addition to McCain, Burwell appears to have other GOP support. Sen Richard Burr (R-N.C.) said he would back her when the Finance Committee votes."

CAPITOL POLICE TO THE RESCUE - The Senate Sergeants-at-Arms explains on its Facebook page: "About 5:30 p.m. Wednesday, a man was leaving the Hart Senate Office Building and started having a heart attack and became unconscious and unresponsive. Officer Nicholas Simons of the United States Capitol Police was on the scene and performed CPR, used the AED defibrillator, and by the time DC Fire showed up to transport him to an area hospital, the man became conscious. Several officers responded to the scene to assist in the medical emergency. Officer Simons was extremely eager to earn his CPR/AED certification--and was able to successfully apply it. This is a fine example of how USCP saves lives."
