LITIGATION US Courts of Appeal Are Less Receptive to Reviewing Class Certification Rulings Skadden recently conducted a study on behalf of the U.S. Chamber of Commerce Institute for Legal Reform regarding acceptance rates for Rule 23(f) petitions appealing class certification rulings in federal courts. The study has confirmed what practitioners have suspected: Obtaining interlocutory appeal of class certification rulings is getting harder, particularly in certain circuits. TAX IRS Large Business and International Division Increasingly Looks to Chief Counsel's Office to Advance Initiatives Tasked with administering tax law to companies and individuals with assets greater than $10 million, the IRS Large Business and International Division has sought to better leverage its limited resources through new initiatives focused on financial institutions, high-wealth individuals, corporate whistleblowers and tax shelter abuse. To help execute its projects, the LB&I increasingly has relied on the expertise of the attorneys in the IRS Office of Chief Counsel. Companies and individuals subject to LB&I regulations need to better understand both how these initiatives may affect their tax decisions and the role that the Chief Counsel’s office plays in LB&I examinations.
